ASSIGNMENT OF RENTS
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS,
(unit owner) _________________________________________________________
has/have certain on-going obligations to the 1349
Race Street Condominium Association
in connection with Unit # ___________, 1349 Race
Street Condominiums, Denver, Colorado, 80206,
WHEREAS,
the Board of Directors of the 1349 Race Street Condominium Association has required that unit owners who choose to rent or
lease their units do so only under certain conditions as assurance that the interests of the Association are being met,
NOW
THEREFORE, in consideration of the unit owner's right to rent or lease their unit for use by non-members of the Association,
and other good and valuable consideration, the receipt of which is hereby acknowledged, the undersigned does/do hereby, in
case of default of the payment by unit owner to the Association for any sum assessed against the unit owner by the Association,
or failure of the unit owner to comply with any of the terms of the Association's governing documents or rules and regulations;
hereby assign(s), transfer(s) and set(s) over unto said Association above described, all rents, profits and income derived
from the premises above described and from the improvements therein, together with all rights of possession, with full and
complete authority and right in the Association to demand, collect, receive and receipt for such rents, profits and income,
to take possession of the premises without requiring the appointment of a receiver therefor, to rent and manage the same from
time to time and to apply the proceeds derived therefrom, after payment of all costs of collections and all fees and other
costs, upon said indebtedness to the Association as may be required by the Association's governing documents or its rules
and regulations are paid in full or until title is obtained through foreclosure or otherwise.
This
agreement shall remain in effect during the entire time that the above named unit owner owns the above indicated unit, and
the above named unit owner is not occupying said unit.
