1349 Race Condominium Association

GENERAL RULES

(as adopted on 6/11/98, with later additions)

 

 

Rule 1 - Maintenance Assessment:

 

The monthly maintenance assessment is due and payable on or before the first day of each month.  If the same is not paid by the 10th day of the month in which the payment is due, a late fee of  $40 shall be assessed against the unit owner who has failed to timely pay the monthly maintenance assessment.  This is in addition to the 18% per annum interest that shall be due on all such late payments (Declarations, Section 22).  All special assessments are due and payable as specified by the Association Board of Directors.  If special assessments are not timely paid, a late fee of $100 shall be paid for each 30-day period that such payment is late.

 

Rule 2 - Condominium Renting:

 

Any renting or leasing of any condominium unit within 1349 Race Street Condos shall be made in writing, and shall be accompanied by the standard Addendum to Lease form which has been approved by the 1349 Race Street Condos Board of Directors.

 

Any unit owner leasing his/her unit MUST execute an Assignment of Rents form in favor of 1349 Race Street Condos to the extent of any maintenance assessments or fees due for that unit.

 

If a 1349 Race Street unit owner does not reside in his/her unit, and some other party or parties does/do live in that unit; the unit shall be considered a rented unit for purposes of this rule. 

 

No renter/lessee shall be permitted to occupy a 1349 Race Street unit until a completed and signed Lease, along with a signed Addendum to Lease and a signed Assignment of Rents form have been filed with the Association President or Manager.

 

Rule 3 - Transfer Fees

 

Beginning January 1, 1998 (modified 12/08), whenever a 1349 Race Street Condo unit is sold, the following fee shall be charged to the owner (seller) of the unit.  Such fee shall be due at the time the contract for sale is submitted, by the owner, to the Association.

 

For units which are being Sold:  $100.00

To cover the cost of supplying to the Listing Agent for the Buyer(s) copies of the Condominium Declaration, Articles of Incorporation, Bylaws, Rules and Regulations, Current Financial Statements and the Association Budget; and, supplying to a Title Company one or two statements about the Seller's financial account with the 1349 Race Street Condos Association.

 

Rule 4 - Parking

 

There is NO guest parking available on the grounds of 1349 Race Street Condos.  All parking spaces are assigned/owned.  Tenants may use Owners parking space at the Owner's written direction.

 

No vehicle belonging to an Owner, Tenant or guest shall be parked in such a manner as to impede or prevent ready access to designated parking spaces belonging to others.

 

Improperly parked vehicles on the grounds of 1349 Race Street Condos will be towed.  While the towing company may change, at the time these Rules were adopted, Classic Towing, Inc., 1485 North Rio Court, Denver (near 13th Avenue and the RTD Light Rail Tracks), is the official towing company for the Association.  Their phone numbers are 620-9787 and 620-9737.  Owners of offending vehicles shall be responsible for any towing and storage charges.

 

Rule 5 - Trash

 

Unit Owners and Tenants are to deposit all trash ONLY in the specially marked 1349 Race dumpsters at the rear of the building, across the alley.  No trash is to be left on porches at any time.  Porches may have a couple of chairs and an active cooking grill, but may not be used for ANY additional storage.

 

Rule 6 - Washing of Cars

 

Car/truck washing on the grounds of 1349 Race Street Condos is prohibited.

 

Rule 7 - Enforcement of Association Rules   (Adopted on January 18, 1999)

 

Written notice shall be given to the owner of any 1349 Race Unit where either the owner, tenant or guest has violated an Association Rule or a provision of the Declaration, Articles of Incorporation or Bylaws (referred to herein collectively as "Rules").  If the written notice does not result in prompt compliance with the Association's published Rules, a second notice shall be sent to the unit owner, along with a bill for $10 to cover the costs associated with the notices.

 

If a unit owner still fails to comply with the Rules (in the judgment of a majority of the Board of Directors) and/or fails to pay the $10 fee within 30 days after being billed, an additional penalty of $50 will be added.  If the unit owner fails to pay the fee and the penalty charge within 30 days of mailing, the total amount will begin bearing interest at the rate of eighteen percent (18%) per annum, and shall be deemed as in violation of Section 17 of the Condominium Declaration for 1349 Race Condominiums.  In that event, the Association's Board may take the steps proscribed therein.

 

Each such failure to comply with the Association's Rules shall be a separate event, and subject to the above process.  

  

Rule 8 - Maintenance of Exterior Stairs   (Adopted on October 25, 2001)

 

Any maintenance and repairs that are needed on the above grade porches and exterior stairways located on the 1349 Race Street Association property, is and shall continue to be, the exclusive responsibility of the appurtenant unit owner. Also, any liability arising out of a failure to maintain such facilities shall be the exclusive responsibility of the appurtenant unit owner.

 

If a unit owner chooses to paint or re-surface such exterior facilities, all metal parts may only be painted black, and wooden stairs may be sealed, but may NOT be painted nor stained.

 

Unit owners are advised to periodically check the structural integrity of all stair-mounting hardware and replace or reinforce as needed.

 

Rule 9 - Exterior Window & Door Replacement   (Adopted on December 8, 2003)

 

The repair, maintenance and/or replacement of exterior windows and doors of units at 1349 Race Street are the responsibility of each individual unit owner.  Since the exterior appearance of the building is subject to the Association’s architectural control of the building; the Association’s membership hereby rules that such work must be done in accordance with adopted Association rules.

  

Rule 10 - Specifications for Exterior Modifications  (Adopted Dec. 8, 2003)

 

The following specifications must be followed when replacing any exterior unit windows, or the installation of any storm/screen/security doors at 1349 Race Street:

1.  Replacement windows must be constructed of white vinyl material, in a horizontal slider style (no bay windows), with each window consisting of two equally-divided glass panes (panels).

2.  The framing members of such replacement windows must be no less than 1½” wide nor more than 2½” wide from brick to glass, filling the entire brick opening with window and framing.

3.  The exterior of newly installed replacement windows must be caulked with white silicon long-life caulk.  Any scars to exterior painted surfaces, done during installation, must be touched-up by the unit owner or their contractor, using paint specified by the Association.

4.  The number of panes (thickness) of each window, and interior finishes are totally options of the individual unit owner.

5.  Any storm/screen/security doors installed after December 8, 2003 shall have a black finish.

 

Variations from the above specifications MUST be approved by the Association Board prior to having work done.  Windows or doors installed out of compliance with these specifications are subject to removal at the unit owner’s expense, upon action by the Board.

 

Rule 11 - Responsibilities for Pets  (Adopted April 25, 2006)

 

1349 Race pet owners must not allow their pets to relieve themselves on or within 20 feet of the 1349 Race property.
